These terms, with the privacy policy, the acceptable use policy and the refund policy, form the whole agreement between you and Baibursai. Where they conflict, these terms take precedence.
You must be 16 or older and able to enter a contract. You are responsible for everything done under your account, including by anyone you share access with. We do not require email verification at signup, which makes keeping your own credentials secure entirely your responsibility. Tell us promptly if you believe they are compromised.
You own everything you send us and everything the agents produce for you. You grant us only the narrow technical licence needed to process, transmit and store it in order to run the service.
We do not use your inputs or outputs to train any model. We do not disclose them. We do not analyse them for any purpose other than delivering the run you asked for and billing you correctly.
You are responsible for having the right to send us whatever you send. Do not put data through these agents that you are not permitted to share with a processor.
Agent output is generated by a statistical model and can be wrong. Accuracy figures we publish are measured averages, not guarantees about any individual run. You are responsible for deciding what to do with the output, and for any review step your use of it requires.
Nothing an agent produces is legal, financial, medical or professional advice, and you must not present it as such to third parties.
The acceptable use policy is binding. In short: nothing illegal, nothing that attacks others, nothing that endangers the platform, and no attempt to extract, reverse engineer or resell the underlying models.
We may suspend or terminate an account that breaches these terms or the AUP, or that we are legally required to act against. Except where harm is ongoing or severe, we will contact you first and give you a chance to fix it.
You may close your account at any time. Unused credit is refundable under the refund policy.
We aim for high availability and publish uptime on the status page, but the standard plan carries no contractual SLA. Because billing is per run, an outage costs you nothing directly: you are not charged for work that did not happen.
Beyond what the law requires, the service is provided as is. We do not warrant that it will be uninterrupted, that it will meet your particular requirements, or that any run will produce a particular result.
Neither party excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data. Our total liability in any twelve-month period is limited to the amount you paid us in that period.
You will indemnify us against third-party claims arising from your use of the service in breach of these terms or the AUP, including claims about data you had no right to send us.
We will email account holders at least 30 days before a material change takes effect. Continuing to use the service after that date means you accept the new terms. If you do not, close your account and claim a refund of unused credit.
These terms are governed by the laws of the jurisdiction in which Baibursai is established, and disputes will be heard by its courts. Nothing here removes mandatory consumer protection you have where you live.
